These Terms of Use ("Terms") govern your access to and use of Kestrah, our websites, and related products and services (collectively, the "Services") provided by Soon Robotics ("Soon Robotics," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian, including through the oversight features Kestrah provides for members under 18.
Your account
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Acceptable use
You agree not to misuse the Services, including by attempting to disrupt or compromise their security or integrity, reverse engineering or interfering with the Services except as permitted by law, using the Services to violate the rights of others or any applicable law, or using the Services to generate or distribute unlawful, harmful, or infringing content.
AI-generated content
Kestrah produces responses using artificial intelligence. While the S.O.U.L. Stack™ is designed to reduce hallucinations and constrain harmful behavior, outputs may be inaccurate, incomplete, or otherwise unsuitable for a given purpose. Kestrah does not provide professional medical, legal, financial, or other licensed advice, and you should not rely on it as a substitute for a qualified professional. You are responsible for evaluating the accuracy and appropriateness of any output before relying on it.
Subscriptions and billing
Certain features may require a paid subscription. Applicable pricing, billing intervals, and renewal terms will be presented at the time of purchase. Unless otherwise stated, subscriptions renew automatically until cancelled, and you may manage or cancel your subscription through your account or the platform through which you subscribed.
Intellectual property
The Services, including all software, text, designs, and the Soon Robotics and Kestrah names and logos, are owned by Soon Robotics or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without our prior written permission.
Third-party services
The Services may link to or interoperate with third-party products and services that we do not control. We are not responsible for the content or practices of those third parties, and your use of them is governed by their own terms and policies.
Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Soon Robotics will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of the Services.
Indemnification
By accessing or using any and all services and products provided by Soon Robotics — including Kestrah and any current or future Soon Robotics products, hardware, software, devices, and platforms (collectively, the "Soon Robotics Offerings") — you agree, to the fullest extent permitted by law, to indemnify, defend, and hold harmless Soon Robotics and its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers (the "Indemnified Parties") from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in any way connected with: (a) your access to or use or misuse of the Soon Robotics Offerings; (b) your violation of these Terms or any applicable law, rule, or regulation; (c) your violation of the rights of any third party, including any intellectual property, privacy, or publicity right; or (d) any content, data, or instructions you submit to, request from, or generate through the Soon Robotics Offerings. Soon Robotics reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claims. This obligation survives the termination of these Terms and your use of the Soon Robotics Offerings.
Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws rules. Any disputes will be resolved in the state or federal courts located in Florida, unless otherwise required by applicable law.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
